TRAI To Penalize Operators For Unsolicited Calls; DoT Considers “Do Call Registry”

Many of our readers agreed that India’s Do Not Call Registry is a failure; despite registering, consumers continue to receive unsolicited calls and messages. Over the past couple of months, not much has changed. Now, the Telecom Regulatory Authority of India has planned to do something about the ineffectiveness of the registry: they’re going to (pdf) impose a financial penalty on service providers - mobile operators like Airtel, BSNL, Vodafone (NYSE: VOD) etc - of a maximum of Rs. 5000 for first instance of non-compliance, and Rs. 20,000 for every subsequent non-compliance. Also, telemarketers are will have to pay Rs. 500 for each first unsolicited call, and Rs. 1000 for every subsequent call.

So...a consumer has to complain to the mobile operator against the telemarketer. This way, aren’t you penalizing the operator for recording that complaint? The operator has an incentive to ignore that complaint, then. Also, if not to the operator, then where else does a consumer complain?

Now it appears the DoT is considering a Do Call Registry - wherein people will choose to opt-in. Would you ever opt in? Reminds me of that phrase in Hindi - aa bel mujhe maar (asking for trouble). Anyway, there’s the status of the Do Not Call Registry so far: 8.3 million users and 13600 telemarketers have registered. Only around 600 telemarketeres access the NDNC daily for ‘scrubbing’ their do not call list. Of 1522 million numbers uploaded by telemarketers, 1411 have been cleared by the NDNC. The issue has been discussed in the Parliament, the Supreme Court, The Delhi High Court and the Reserve Bank of India. Consumer representations have been made.

    if there i get 10 Rs for every Telemarketing call i get i will be a millionaire. this got to be stopped ..situation is so bad that today people don’t pick up any call from unknown land line number . believe it or not i have got personal loan call at 10:30PM on Saturday . this is pathetic

    NDNC has been a failure and it is no rocket science to understand why? Regulations which have worked very well in an informed/ educated and wired society like the west would not but somehow the govt and TRAI repeatedly put their foot into their mouth.
    receiving unsolicited calls is a small price to pay to stay connected 24 x 7.
    I have seen people abusing telemarketers no end and losing their cool in the bargain
    why fray your nerves and blood pressure over such a trivial issue? there’s always the disconnect button which works very similarily to the swap button on the TV remote when you are bombarded with uncalled for advtg. I had registered myself with NDNC but am still swamped with unsolicited calls at the most unearthly hours. I am also a victim of the abuse but there is absolutely nothing which either the TRAI or the operators can do about it. The calls would continue unabated................reminds me of the classic.........when rape is inevitable...............lie back and enjoy it!

    I agree NDNC has been a total faliure, if you do want you name on the do not call list, there is a 45 days waiting period. WHY? I think i have my cell number of every list i can find but somehow my phone keeps ringing with unsolicited calls, the people callin do not give out their true name or identity which makes it impossible to trace them. I have compiled a list of DO NOT CALL for banks, cell phone companies incase you want your number off them.

    Is there any way to stop incoming promotional calls from Various Banks regarding Loans, Credit Card, Investments etc.?
